1. Introduction

Welcome to ParkNow! By using our application, you agree to these Terms of Use, which govern your use of our services. Please review them carefully.

2. User Eligibility

You must be at least 18 years old to use ParkNow. By registering, you confirm thatyou meet this age requirement and have the authority to agree to these terms.

3. Account Registration and Security

You are responsible for keeping your account details confidential and secure. Any activity conducted under your account is your responsibility. If you suspect unauthorized use, notify us immediately.

4. Independent User Agreements

ParkNow is a platform that connects parking space seekers with parking space hosts. However, we are not a party to any agreements made between users and hosts.

  • No Involvement in Transactions: All communications, agreements, and transactions are strictly between the user and the host.
  • Release of Liability: By using ParkNow, you release us from any claims, damages, or disputes that may arise from interactions, agreements, or transactions between users and hosts.

5. Parking Space Listings

If you list a parking space, you confirm that:

  • The information provided is accurate and current.
  • You have the legal right to offer the space.
  • You are solely responsible for managing availability, setting terms, and ensuring that the space complies with any applicable laws or regulations.

6. User Conduct

You agree to use ParkNow responsibly and not to:

  • Violate any applicable laws or regulations.
  • Use ParkNow to communicate or share fraudulent, misleading, or harmful content.
  • Harass, threaten, or abuse other users.

7. Privacy Policy

Our Privacy Policy, which details how we handle your personal information, is incorporated into these terms. By using ParkNow, you consent to our data practices as outlined.

8. Limitation of Liability

ParkNow is not liable for any damages, losses, or disputes resulting from the use of our app or from interactions between users and hosts. ParkNow does not assume responsibility for the condition, availability, or legality of listed parking spaces.

10. Modifications to the Terms

ParkNow reserves the right to modify these Terms of Use at any time. You will be notified of any significant changes, and your continued use of the app signifies acceptance of the updated terms.

11. Prohibited Uses

By using ParkNow, you agree not to:

  • Use the app for any unauthorized or illegal purpose.
  • Interfere with or disrupt the app’s operation or attempt to gain unauthorized access to systems or data.
  • Post content that is false, misleading, offensive, or violates any law or regulation.
  • Engage in spam, phishing, or other deceptive practices.

12. Account Suspension and Termination

ParkNow reserves the right to suspend or terminate accounts that violate these Terms of Use or engage in prohibited behaviors.

  • Grounds for Suspension or Termination: This includes, but is not limited to, fraudulent activity, harassment, misuse of the platform, or providing false information.
  • No Refunds for Subscription Termination: If a subscription is terminated due to violations, no refunds will be provided.

13. Third-Party Services and Links

ParkNow may include links to third-party websites or services, which are provided solely for your convenience.

  • No Control Over Third-Party Services: We do not endorse or assume responsibility for any third-party websites or services accessed via ParkNow.
  • User Responsibility for Third-Party Terms: It is your responsibility to review and accept the terms and policies of any third-party services you interact with.

14. Disclaimer of Warranties

ParkNow is provided on an “as is” and “as available” basis. We make no warranties, expressed or implied, regarding the app’s operation, availability, or fitness for any particular purpose.

  • Service Availability: We do not guarantee that the app will be available at all times or that it will be free of bugs, errors, or interruptions.

15. Updates and Changes to Services

ParkNow reserves the right to modify or discontinue any part of the app at any time.

  • App Updates: We may periodically release updates to enhance functionality, improve security, or correct issues.
  • User Notification: You will be notified of any significant changes to core app functionality that may impact your use of the app.

End User License Agreement (EULA)

1. Agreement to Terms

This End User License Agreement (“Agreement”) is a legally binding agreement between you (“User,” “you”) and ParkNow (“Company,” “we,” “us,” or “our”), governing your use of the ParkNow mobile application (“App”) and related services (“Services”).

By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this EULA. If you do not agree with the terms, you may not download, install, or use the App.

2. License Grant

Subject to your compliance with the terms of this EULA ParkNow you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device owned or controlled by you, for personal, non-commercial purposes.

3. Restrictions on Use

You agree not to:

  • Copy, modify, distribute, create derivative works of, reverse engineer, decompile, or attempt to extract the source code of the App.
  • Rent, lease, sell, redistribute, sublicense, or transfer the App to any third party.
  • Use the App in any manner that violates any applicable laws or regulations, or in any way that could harm, disable, overburden, or impair the App.

4. Ownership and Intellectual Property

The App, its content, and all associated intellectual property rights, including but not limited to text, graphics, logos, audio files, and software, are the exclusive property of ParkNow. You do not acquire any ownership rights in the App by using it. This license grants you the right to use the App but does not transfer any ownership of intellectual property.

5. In-App Purchases and Subscriptions

The App may offer in-app purchases, including subscriptions. By purchasing or subscribing to any content or services, you agree to pay the applicable fees and abide by any additional terms provided at the time of purchase.

In-app purchases are non-refundable, except as required by applicable law. Please review Apple App Store’s terms for payment and billing details.

6. Account and Privacy

You may be required to create an account to use certain features of the App. You agree to provide accurate and complete information and to update your account as necessary. You are responsible for maintaining the security of your account, including your login credentials.

7. Termination

This EULA is effective until terminated by either you or ParkNow. You may terminate this EULA by deleting the App and ceasing all use of it. We may terminate this agreement at any time without notice if you violate any terms of this EULA.

Upon termination, the license granted to you under this EULA will immediately cease, and you must delete or remove the App from your device.

8. Updates and Modifications

ParkNow reserves the right to modify or update the App, including this EULA, at any time. If we make material changes to this EULA, we will notify you by updating the “Effective Date” above or by other appropriate means. Continued use of the App following the posting of updates constitutes acceptance of the revised EULA.

9. No Warranty

The App is provided “as is” without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. ParkNow does not guarantee that the App will be error-free, uninterrupted, or free from harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, in no event shall ParkNow or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.

11. Severability

If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
